Registration and terms

This sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above described property not included in the judgment in the above-entitled cause. A cash deposit of 20 percent of the successful bid will be required. In addition, the successful bidder will be required, at the time the Deed is recorded to pay for recording fees and revenue stamps assessed by the Scotland County Register of Deeds. This sale is subject to upset bid as set forth in N.C.G.S. Section 1-339.25.

THE MAX BID IS A WALK-AWAY PRICE, NOT AN OPENING BID, AND NORTH CAROLINA WILL TEST IT. Any sale can be upset within ten days by 5% or $750, whichever is greater, and each upset restarts the ten days. Bidding the computed ceiling at the auction leaves nowhere to go when someone raises it, and matching the raise puts the operator past the ceiling. Bid low, expect to be upset, and treat the computed figure as the point at which to stop — in this state, uniquely, that discipline is enforced by the process rather than left to the bidder.

SOME TAX LIENS SURVIVE, BY NAME. G.S. 105-375 conveys fee simple free and clear "except the liens of other taxes or special assessments not paid from the purchase price and not included in the judgment, liens arising from C-PACE assessments authorized under Article 10B of Chapter 160A of the General Statutes, and conservation agreements". A tax year outside the judgment stays with the parcel, and C-PACE — commercial energy financing, repaid through the tax bill — can be a large balance that survives specifically because it is not an ordinary lien.
