MS caveats

A COUNTY CLERK'S MISTAKE VOIDS THE SALE, AND THE CLERK IS NOT LIABLE. § 27-43-3 requires the chancery clerk to notify the owner at least forty-five days before the redemption period expires, by personal service or service at the abode, by registered or certified mail, and by publication. Then: "Should the clerk inadvertently fail to send notice as prescribed in this section, then the sale shall be void and the clerk shall not be liable to the purchaser or owner upon refund of all purchase money paid." The purchase money comes back; the position, the two years of accrued interest and the deal do not, and nothing the investor does can prevent it. Mississippi tax sales are voided on this ground routinely.
THE OVERBID IS A DEAD LOSS AND EARNS NOTHING. Mississippi bids up from the face amount, and the 5% damages and 1.5% monthly interest under § 27-45-3 run on "all such taxes and costs" — not on the premium. If the owner redeems, § 27-41-77 keeps the excess with the county rather than returning it. So a bidder who pays a 40% premium has turned an 18% instrument into roughly 13% and forfeited the premium outright. The tier is the statutory rate on the face amount, not the yield on the money spent.
A FLAT 5% SITS ON TOP OF THE 18%. § 27-45-3 adds "five percent (5%) damages" on the amount of taxes, separately from the monthly interest. The tier holds one number and cannot carry both, so the 5% is not in the computed return.
