THE DEED IS SUBJECT TO EARLIER PERFECTED INTERESTS. § 7-38-70 conveys the former owner's interest as of the date the tax lien arose, 'subject only to perfected interests in the real property existing before' that date. A mortgage or judgment perfected before the lien arose survives the sale. Establish the lien date and search back from it before treating survivingLiens as zero.
TWO YEARS OF CHALLENGE RISK THAT PAYS NOTHING. The former owner, or anyone claiming through them, is barred from challenging the conveyance only after two years from the date of sale. That is a defect window rather than a redemption — no penalty accrues to the purchaser for waiting it out, so it is pure carry.
THE STATE SELLS, NOT THE COUNTY. Sales are conducted by the Property Tax Division of the Taxation and Revenue Department under § 7-38-65, which may sell at any time after three years from the first delinquency date. Procedure, notice and catalogue are the Division's, not each county's.
