Buyer-beware research via Hays CAD and deed records.

Auction logistics

Format

In-person

Frequency

First Tuesday of each month when judgments are set (10:00 a.m.–4:00 p.m.)

Deposit rules

In-person bidding; payment typically cash or cashier's check same day for exact amount. Obtain Statement of No Delinquent Taxes / bidder authorization from Hays County Tax Assessor-Collector under Tax Code §34.015 before a constable's deed issues. Confirm current payee, registration, and any pre-sale form requirements with the constable/tax office for the sale month. Post-judgment taxes may be due beyond judgment amount.

Title risk

Liens that survive the sale
HOA/POA liens can survive a Texas tax sale if the association recorded its lien and was not properly joined/notified in the foreclosure suit. Federal tax liens survive (IRS rights). Post-judgment taxes and unjoined municipal liens may remain — search deed records and the appraisal district before bidding. Sheriff/constable deed is without warranty.
Quiet title
Not legally mandatory, but title companies generally require a completed suit to quiet title before insuring, because of statutory redemption rights (homestead/ag up to 2 years; others ~180 days) and possible un-joined lienholders.
